Terms of Service

1. Acceptance of Terms

By creating an account or using MyJarvix (“we,” “us,” “our”), you agree to be bound by these Terms of Service (“Terms”). MyJarvix is a product of Albi Forge Inc., a company registered in the State of Washington, USA.

2. The Service

We provide a platform for users to run hosted instances of the OpenClaw AI agent (“Service”). The Service is provided on a subscription and/or credit-based model.

  • Infrastructure Maintenance: We reserve the right to perform maintenance, upgrades, or remediation on the underlying infrastructure at any time. If a server hosting your instance experiences issues (including hardware failure, instability, or security incidents), we may redeploy, reset, or migrate your instance to restore service. We will make reasonable efforts to notify you in advance, except where immediate action is required.

3. Accounts and Responsibilities

  • Eligibility: You must be at least 16 years old to use the Service.
  • Account Security: You are responsible for maintaining the security of your account and password.
  • Acceptable Use: You agree not to use the Service for any illegal or abusive purpose. You will not attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service.

Prohibited Activities

Without limiting the above, you specifically agree not to use the Service to:

  • Generate or distribute illegal content, including child sexual abuse material or content that incites violence or hatred against any group.
  • Create content intended for fraud, phishing, impersonation, or other deceptive purposes.
  • Abuse API quotas, circumvent usage limits, or create multiple accounts to obtain resources beyond your entitlement.
  • Access, interfere with, or compromise the isolated environments of other users.
  • Attack, probe, scan, or disrupt third-party systems or networks, including distributed denial-of-service (DDoS) attacks.
  • Upload or process content that infringes third-party intellectual property rights without authorization.
  • Engage in cryptocurrency mining, sustained high-CPU workloads unrelated to AI inference, or any activity that places unreasonable or disproportionate load on the infrastructure.

Violation of these prohibitions may result in immediate suspension or termination of your account without notice.

4. User Content

  • Your Responsibility: You are solely responsible for any data, text, prompts, or files you provide to the Service ("User Content"). You represent that you have all necessary rights to your User Content.
  • AI-Generated Content: You acknowledge that output generated by AI models may not always be accurate, complete, or appropriate. We are not liable for any AI-generated content.
  • License to Us: To provide the Service, you grant us a limited, worldwide, non-exclusive license to use, reproduce, modify, and transmit your User Content solely for the purpose of operating and providing the Service to you. This includes transmitting your User Content to third-party AI model providers.

5. Payments, Subscriptions, and Credits

  • Billing: We use Stripe for all payment processing. By providing a payment method, you agree to our pricing and billing terms.
  • Subscriptions: Subscriptions are billed on a recurring basis (e.g., monthly) and will automatically renew unless you cancel. If you cancel, your subscription will remain active until the end of the current billing period. No refunds or credits are issued for unused portions of a billing period.
  • Credits: Credits are the internal currency of the Service, used to pay for token consumption. Credits can be granted via subscriptions or purchased in one-time packs. Credits are non-refundable and have no cash value.
  • Plan changes: When you change your subscription plan (including upgrading, downgrading, or resubscribing), we do not refund subscription fees you have already been charged for the billing period in effect at the time of the change. Unused time on a prior plan or tier is not refunded.
  • Platform plan and credits: If you subscribe to the Platform plan and later switch to the Starter or Pro plan, any MyJarvix credits remaining on your account are not forfeited, but you may not use those credits for platform-managed AI usage while your subscription is on Starter or Pro. Those credits become available for platform-managed usage again only if you return to the Platform plan, subject to the continued validity and rules of the credit system.

6. Third-Party Services

The Service relies on third-party services, including AI model providers (e.g., OpenAI) and payment processors (Stripe). Your use of the Service is also subject to their respective terms and policies. We are not responsible for the availability or performance of these third-party services.

7. Termination

  • By You: You may terminate your account at any time through your account settings or by contacting us.
  • By Us: We reserve the right to suspend or terminate your account at any time for a violation of these Terms. We will make reasonable efforts to notify you prior to termination except in cases of serious violations.
  • Effect of Termination: Upon termination, your access to the Service will cease immediately. Your personal data will be permanently deleted within 30 days. Billing and payment records are retained for 7 years as required by law. We do not currently offer a data export feature prior to account deletion.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

WE DO NOT GUARANTEE THE PRESERVATION OF ANY USER DATA, CONFIGURATIONS, CONVERSATION HISTORY, OR OTHER CONTENT STORED WITHIN YOUR INSTANCE. DATA LOSS MAY OCCUR DUE TO HARDWARE FAILURE, SOFTWARE ERRORS, INFRASTRUCTURE MIGRATIONS, OR OTHER CIRCUMSTANCES BEYOND OUR CONTROL. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING BACKUPS OF ANY DATA YOU WISH TO PRESERVE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM.

9. Dispute Resolution

Before filing any legal claim, you agree to first contact us at [email protected] and give us 30 days to attempt to resolve the dispute informally. If the dispute is not resolved within that period, either party may pursue available legal remedies.

10. Governing Law

These Terms shall be governed by the laws of the State of Washington, USA, without regard to its conflict of law provisions.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by email to the address associated with your account. Continued use of the Service after the effective date of the changes constitutes your acceptance of the new Terms.
